Anyway, they really have completely lost the plot. Passing laws never has, and never will, stop people from thinking or saying x, y, z, whatever. It just - to borrow an all-too-often used phrase - pushes those who hold the opinions in question, underground, where it's much harder to challenge said views with informed, logical arguments. Sorry though, but it's extremely naïve to buy into the notion of them "trying to stand up for minorities". If they gave a shit about minorities, why has it taken them 10 years to get to this point? The real reason they're intending to pass such draconian legislation is to have more grounds to keep track of us, and to place more restrictions on us for their own pathetic gains. I mean, we won't even be able to protest outside Parliament next! Oh wait...

I think it's ridiculous and unfair to say that Jim Davidson tells gay jokes. He's never made a joke in his life.

Yep. One thing the Conservatives do do well is looking at the long term picture because, well they are conservative. I can't help feel they would have handle 9/11 and all that Jazz better. Having said that I would now be paying health insurance, have no education and would have a fear of foreigners under the Tories :P

lol, well the last one very much depends on which extreme you fall under (and which paper you read, and how literally you take it). Health insurance, that'd never seriously be introduced to that extent. Maggie would have brought it in if she could have got away with it, so certainly no present MP would. Education, not sure I follow there...

For the most part, our constitution is uncodified. Which means - to generalise and simplify quite a bit - that it is, as Adam said, not written down. Rather, it's lead by principle, precedent, tradition and such.

However, we do have the 1689 English Bill of Rights (text here), which makes it quite clear "That all grants and promises of fines and forfeitures of particular persons before conviction are illegal and void."

In other words, on-the-spot fines are illegal.

Of course, that being an ENGLISH Bill of Rights, the incumbent overwhelmingly Scottish Government, far from respecting it, probably are intentionally going out of their way to contravene it. But that's another debate altogether. :)
