I can't personally think of an occasion where if I was angry at someone I would call them a black c**t. I reckon he probably is a big old racist.
But whether that can or should have been proven in court in this instance I can't say.

You might if you are an angry racist, or are a massive, ignorant twat who decides to use racist phrases to hurt or get a reaction out of someone.
The idea that when you combine the words black and c**t that you are not trying to turn the word black into something negative is absurd. The combination of the words makes it so. And if you're saying black is something negative, then that's surely racist.

Yeah, I'm not sure this should really have gone to court.
Personally I try not to (and generally succeed) use any physical aspect of a person as an insult, and would rather insult them based on their actions. So I wouldn't call John terry a white weasely faced spikey haired knob end, I would call him a morally abhorrent, home wrecking shit turd.

Intent is very important in law, but you can't change the meaning of a word just by wanting to. If I call you a 'Cumbrian c**t' you wouldn't be offended because coming from Cumbria isn't a bad thing in your mind (or mine, obviously).
People think 'black c**t' is racist because they are conditioned to associate any mention of race with - to use your word: 'negative' intent. The sentence in itself is not racist, merely descriptive as it would be with any other adjective.

So when you insult people, you try wherever possible not to hurt their personal feelings? There's no logic to that at all.
I don't think the words 'black c**t' are racist in themselves. Of course they're not.
It all depends on context, and the fact he was angry. If he'd been affectionately saying 'come here ya black c**t' and cuddling him, and that was the way those two people often spoke to one another, no one would be accusing him of being out of order.
The fact that the man he called a black c**t (who presumably knows him to an extent, and the way he normally expresses himself) thinks he was being racist says quite a lot.

I can see the logic. Totally hurt their feelings, but not about something they have no say in. I don't dislike people based on how they look/where they are from (apart from the Scottsh), so prefer not to make that part of the insult. I don't want to be that person. That person is a massive twatgallop.
