He didn't shoot him because he looked suspicious, he killed him because he says he feared for his life.
Fact: the dead man was committing a crime.
Fact: the shooter was tasked with patrolling the neighborhood.
Fact: the kid tried to evade the shooter and conceal his identity.
Fact: the two men struggled at some point.
All the shooter has to do is prove that he acted in self-defence. If any of the following are also factual, then the shooting was justified and legal:
If the kid made an aggressive move toward the man.
If the kid threatened the man.
If the kid tried to grab the man's firearm.
If the kid reached in his waistband or pocket.
Unless there are witness who can prove that the young man made no aggressive or suspicious moves, the guy won't be charged.
