I would imagine that the defence he'll put up is that he wasn't in a fit state of mind and was still greiving the violent death of his wife and unborn baby.
People handle grief in different ways, some turn to drink, some turn to drugs and some make Oscar winning Hollywood films and then rape 13 year old girls. The human psyche is really complex.

I took a film class on great directors and Polanski was one of them. We were supposed to study him for 2 weeks and instead spent half the semester talking about him, Sharon Tate, The Manson Family, his legal mess, and him leaving the US. There are so many opinions and angles to this. I'm really curious to see how this all plays out.
