It's not for the court to decide, but to consider; yes. I'm unfamiliar with the technicalities of the relevant legislation, but the crime was accessing it at all. The reasons for doing so aren't really taken into account, AFAIK. And the detectives would be on some kind of ... Gawd, I can't think of the word, but they're doing it as part of a criminal investigation, not looking at it of their own accord or as something which would interest them.
Or something.
Anyway. Definitely echo the comments on his acting talent and performance in The Thick Of It. As can be expected I'm not a massive fan of the show, but Langham plays the character perfectly. That almost childlike innocence when he's sat in the tiny kitchen but in Number 10 is brilliant.
