I said childishly naïve...and they are. It's the same with anyone who thinks they can solve a problem with a simple ban or law change.

That was why the initial extradition request was refused. The European Court handed down a judgment in Jan 2013 that Italian prisons were overcrowded and skanky. Italy were given a year to sort them out - and they didn't.

There was a prior ruling from the High Court saying Italian prisons bad and Italian assurances of decent treatment of the prisoner insufficient until they sorted out their prisons.

Because this decision was in the Magistrates' Court, the judge was bound by the High Court ruling.

However, on appeal to the High Court, it is possible that this decision could have been overruled.

Unfortunately, they didn't get the paperwork in in time to see.
